Swopp In Person Sale Agreement

The buyer (Avenir Smart Solutions (Pty) Ltd 2021/619866/07 t/a Swopp) will procure goods from the buyer (as submitted below) after inspection and meeting all the qualifying criteria of the functionality of the device and the device’s condition, payment will be made to the beneficiary’s provided banking details after receiving/collecting the goods.

The payment information, address and device specifications should be provided by the seller before the shipment of the item(s) and a quote should be agreed upon as per the described device if shipment is applicable. In the event that the item does not match the description provided by the seller, the buyer has the right to change/amend their offer, and will inform the seller.

If the items are found not as described as per the condition or functionality, the buyer has the right to withdraw from the sale or amend the quoted offer for purchase and final offer is to be accepted by the seller, otherwise the items will be shipped back to the supplier/seller.

It is the seller’s responsibility to provide the correct bank account details for payment. Should payment be made to the bank account details provided on this form and the seller only informs Avenir Smart Solutions (Pty) Ltd t/a Swopp after the fact, the buyer cannot be held liable and the onus lays with the seller to dispute the payment with their respective bank.

The buyer confirms that in any event that the device becomes iCloud locked, user locked or blacklisted the seller will be held liable for damages and if damages are not repaid, legal action will be taken and a case will be opened with the SAPS and other relevant parties for fraud or theft.

Avenir Smart Solutions (Pty) Ltd is given the express right to obtain lost monies and damages of full purchase amount plus recovery costs incurred by a third party debt-collector.

The seller shall be listed and reported to all major credit burros as a default payer within 28 days of the first notice and a criminal investigation and report will be initiated.

When entering this agreement, you expressly state that you are the owner of the device being sold, and are entitled to transfer ownership of the goods to Avenir Smart Solutions (Pty) Ltd trading as Swopp.

Swopp is a registered secondhand goods reseller with the South African Police service, certificate number (A100217)
